The Supreme Court handed down a major decision last week—not on birthright citizenship itself, but on whether federal judges can issue nationwide injunctions that halt presidential policies. The case stemmed from efforts to block Donald Trump’s executive order targeting the 14th Amendment’s guarantee of citizenship to anyone born in the U.S. While the Court claimed to avoid the citizenship question, critics say the justices still legitimized a fringe legal theory by entertaining it at all.
